A legal framework for the independence of justice and the protection of fundamental rights in Senegal
As part of its project “Senegal: One Power, Two Mandates,” AfricTivistes has developed a legal framework that offers recommendations for reforms aimed at ensuring the independence of justice, public security, and protecting fundamental rights in Senegal, while strengthening participatory democracy.
The legal framework “Diagnosis of the Senegalese Legal Framework” thoroughly explores the constitutional provisions and existing laws governing fundamental rights such as the freedoms of assembly, access to the internet, free candidacy, and the independence of justice.
Indeed, in Senegal, as in several other African countries, populations have often borne the consequences of the quest for a third presidential term. The lack of term limits can lead to serious socio-political instabilities that can generate perpetual tensions and a deterioration of the rule of law. In Senegal, the electoral process period has been characterized by a questioning of a number of fundamental rights.
Thus, the recommendations of this legal frameworkregarding laws concerning freedoms are based on knowledge of applicable legal texts for proposals to revise those texts that do not respect individual and collective rights. They are also based on a comprehensive understanding of the local, political, and social context.
The goal of this production is therefore to provide an assessment, as well as to formulate concrete recommendations for a necessary reform of the Senegalese legal framework. These recommendations aim to restore a balance between public security and the preservation of citizens’ rights, while strengthening participatory democracy.
