Objective(s)
To assess the current state of Senegal’s legal framework and make concrete recommendations for reforms aimed at guaranteeing the independence of the judiciary, public safety and the protection of fundamental rights, whilst strengthening participatory democracy.

Overview
The Legal Briefing — “Assessment of Senegal’s Legal Framework” — is the third deliverable of the “Senegal: One Power, Two Terms” project, published on 8 October 2024. It explores in depth the constitutional provisions and laws in force governing fundamental rights — freedom of assembly, access to the internet, freedom to stand for election and the independence of the judiciary — and sets out concrete recommendations for a necessary reform of Senegal’s legal framework.
CONTEXT
In Senegal, the recent electoral process has been marked by challenges to numerous fundamental rights. The absence of term limits for the presidency could lead to serious socio-political instability, potentially resulting in ongoing tensions and the erosion of the rule of law. This legal review addresses the need to restore a balance between public security and the protection of citizens’ rights.
APPROACH
The recommendations are based on a thorough knowledge of the relevant legislation and a comprehensive understanding of the local, political and social context. The aim is to inform the public whilst encouraging constructive debate on the necessary legal reforms.
